Responding to the call, two officers arrived at the scene at 12:10 am and apprehended the couple under the charge of "committing an act outraging public decency," which is a violation of Section 148(1) of the Crimes Ordinance.
During the hearing, the defense lawyer attributed the couple's actions to impulse, emphasizing that they had pleaded guilty at the earliest opportunity. The lawyer further highlighted that FA and CRV were in a relationship, expressed remorse for their actions, and vowed not to repeat the offense. Taking these factors into consideration, Magistrate Stephanie Tsui decided to give them a second chance and imposed a fine as the penalty. It is worth noting that the offense carries a maximum imprisonment term of six months.
Standing side by side, FA and CRV listened to Magistrate Tsui's decision. They were granted until 4 pm to pay the fine and subsequently proceeded to the cashier's office on the 7th floor of the courthouse. Notably, they left the premises while holding hands.
