Filipino Avoids Trial by Pleading Guilty to Inflicting Harm

On September 20, 2024, a Filipino man, J. Dagohoy, 37, pleaded guilty in Eastern Court to charges of inflicting grievous bodily harm. This decision came after the charge against him was amended from common assault, which he had initially denied.

The incident occurred on March 9 during a drunken altercation in Central. Dagohoy was involved in a commotion near a newspaper stand operated by Cheung Chun Yu, a local man. After Cheung attempted to push Dagohoy away from his store, Dagohoy retaliated by punching him, resulting in a minor cut to Cheung's face.


Dagohoy's defense lawyer described the injury as minor and suggested community service as an appropriate punishment. Principal Magistrate Don So ordered a background report and postponed sentencing until October 10. Meanwhile, Dagohoy, who was out on bail, was taken into custody.


Under Hong Kong law, inflicting grievous bodily harm can result in a sentence of up to three years, while common assault carries a maximum penalty of one year.

Dagohoy的辯護律師將受害者的傷害描述為輕微,並建議以社區服務作為懲罰。首席裁判官蘇俊輝命令進行背景報告,並將宣判推遲至10月10日。同時,Dagohoy在保釋期間被拘留。


根據香港法律,造成嚴重身體傷害的罪行可判處最高三年監禁,而普通襲擊則最高可判處一年監禁。
